Niet iedereen mag zomaar een hondenpension beginnen. Een pensionhouder dient het vakbekwaamheidsbewijs Houder van honden en katten in bezit te hebben, hiermee voldoet hij aan de wettelijke eisen die door de overheid zijn opgesteld in het Besluit houders van dieren (voorheen Honden– en kattenbesluit). Hierin staat bijvoorbeeld beschreven waar de huisvesting en verzorging aan moeten voldoen en hoe de bedrijfsvoering geregeld moet zijn.
Pensions die aangesloten zijn bij de brancheorganisatie Dibevo kunnen alleen aansluiten als ze aan de wettelijke eisen voldoen. Verder zijn de Landelijke Inspectiedienst Dierenbescherming (LID) en NVWA verantwoordelijk voor toezicht en controleren van hondenpensions.
